A. IMPORTANT NOTICE

This handbook forms part of the official LearnWithNMT Learning Agreement, Terms & Conditions and Student Policies. By purchasing, booking, enrolling in, accessing, or participating in any LearnWithNMT service, learners acknowledge that they have read, understood, and agreed to the policies contained within this handbook. For learners under the age of 18, a parent or legal guardian accepts these policies on the learner's behalf. LearnWithNMT reserves the right to update, amend, modify, replace, or remove any part of this handbook at its discretion. Updated versions may be published on the LearnWithNMT website and become effective from the date of publication unless otherwise stated. This handbook shall be governed by and interpreted in accordance with the laws of the Republic of Mauritius.

Welcome to LearnWithNMT. This handbook explains the Terms & Conditions, learning agreement, booking rules, package rules, student responsibilities, and academy policies that apply to LearnWithNMT online English lessons, programmes, e-learning resources, and portal access. By using LearnWithNMT services, learners agree to follow this handbook. For learners under 18, the parent or legal guardian accepts these terms on behalf of the learner.

2. About LearnWithNMT

LearnWithNMT is an online English language training service based in Mauritius. Services are delivered online to learners internationally through live online lessons, Microsoft Teams, Microsoft Bookings, student portal tools, trainer portal tools, e-learning resources, homework, and progress tracking. LearnWithNMT is designed to provide clear, structured, supportive, and professional English language learning for children, young learners, teenagers, adults, business professionals, and group learners.

3. Services Offered

LearnWithNMT may offer the following services, depending on availability and published website information: General English; Conversational English; Business English; English for Children (6-9); English for Young Learners (10-12); English for Teenagers (13-17); English for Adults (18+); One-to-one online lessons; Group lessons and structured group courses; Long-term programmes; E-learning access; Homework, assessments, quizzes, progress reports, and learning resources. All services are provided online unless otherwise stated in writing by LearnWithNMT.

4. Student Registration and Eligibility

Learners aged 18 and above may register independently. Learners under 18 must be registered by a parent or legal guardian, or must have clear permission from a parent or legal guardian. Registration information must be accurate and up to date. Learners must provide a valid email address for booking confirmations and lesson communication. LearnWithNMT may request additional learning information to provide a suitable service. LearnWithNMT may refuse or cancel registration where information is false, incomplete, inappropriate, or misleading.

5. Parent and Guardian Responsibilities

For learners under 18, the parent or legal guardian is responsible for approving registration, selecting suitable lessons, ensuring attendance, monitoring communication, and supporting the learner where necessary. Parents/guardians must ensure the child has a safe, appropriate, and quiet learning environment. Parents/guardians should remain reachable during lessons for young learners where appropriate. Parents/guardians accept the Terms & Conditions, payment rules, cancellation rules, and privacy notice on behalf of the minor learner. Parent/guardian consent may be required through a separate registration or acknowledgement form.

6. Lesson Packages and Long-Term Programmes

LearnWithNMT offers flexible standard lesson packages and structured long-term programmes. Standard packages are based on the number of lessons purchased. Long-term programmes are designed for learners who want a more structured learning plan and consistent weekly progress.

Long-term programmes are different from standard packages because they include a structured learning pathway, recommended weekly frequency, and a stronger commitment to regular progress.

7. Package Validity and Extension Requests

All lesson packages must be used within the validity period shown below, starting from the date of purchase unless otherwise stated in writing.

Unused lessons remaining after the validity period may expire and may not be refunded. LearnWithNMT may consider extension requests on a case-by-case basis, solely at its discretion. Extension requests should be made before the package expires and may require a valid reason such as illness, emergency, travel, or exceptional circumstances.

8. Lesson Credit System

After successful payment, lesson credits will be added to the student account. One lesson credit generally represents one booked live lesson. The student portal should display the package purchased, total credits, remaining credits, validity date, booking history, and e-learning access status where applicable.

9. Bookings, Outlook Calendar and Microsoft Teams

LearnWithNMT may use Microsoft Bookings, Outlook Calendar, Microsoft Teams, the LearnWithNMT website, and/or the student portal to manage lesson scheduling and online delivery. The booking system may display available lesson slots, send confirmation emails, create calendar invitations, generate Teams meeting links, and send reminders.

10. Student Portal

The LearnWithNMT student portal may include lesson booking, remaining lesson credits, package validity, e-learning access, homework, submitted assignments, progress tracking, resources, reports, certificates, and account information.

11. Trainer Portal

The trainer portal may be used to manage student records, attendance, lesson notes, homework submissions, progress reports, resources, objectives, package details, lesson credits, e-learning access, and booking information. The trainer portal supports learning management and administrative accuracy. The trainer may mark lessons as completed, cancelled, rescheduled, or missed. Homework submissions should show the student name, assigned date, submission date, and status. Reports and feedback may be stored for progress tracking.

12. E-Learning Access

Where e-learning access is included or purchased, access remains active for the duration of the associated package or programme. E-learning access is personal to the registered learner and must not be shared. E-learning resources may include slides, quizzes, practice activities, audio, worksheets, and self-study tasks. E-learning access may be suspended when a package expires, payment is incomplete, or misuse is detected. E-learning content is provided for learning support and does not guarantee specific results. Access may depend on the technical availability of the website, portal, or learning platform.

13. Homework, Assessments and Progress Reports

LearnWithNMT may assign homework, quizzes, assessments, practice activities, or written tasks. These activities are designed to support learner progress and help the trainer identify strengths, weaknesses, and next steps.

14. Scheduling, Attendance and Late Arrivals

Learners are expected to attend lessons on time. If a learner arrives late, the lesson will normally still end at the scheduled time and will not be extended.

15. Cancellation and Rescheduling Policy

Students may reschedule a lesson by giving at least 6 hours notice before the scheduled lesson time. When a lesson is cancelled or rescheduled with sufficient notice, the lesson credit may be returned or preserved for future use. If a learner cancels with less than 6 hours notice, does not attend, or misses the lesson without notice, the lesson credit may be forfeited and the lesson may be marked as completed or missed. LearnWithNMT may make exceptions in serious or exceptional circumstances, but this is not guaranteed and remains at LearnWithNMT's discretion.

16. Trainer Cancellation Policy

If LearnWithNMT needs to cancel or reschedule a lesson due to illness, emergency, technical issue, or unavoidable circumstances, the learner will not lose the lesson credit. The lesson may be rescheduled to another available time. The lesson credit may be returned to the learner account. For group lessons, LearnWithNMT may provide a replacement class, alternative date, or suitable learning solution.

17. Group Lesson Policy

Group lessons and group programmes are designed for shared learning. They may follow a fixed schedule and require a minimum number of learners to run.

18. Payment Terms

Payments must be made through the LearnWithNMT website unless LearnWithNMT gives written approval for another method. Accepted payment methods may include PayPal, Visa, Mastercard, and American Express, depending on availability and payment provider rules.

19. Refund Policy

Payments are non-refundable once lessons, programmes, packages, or e-learning access have commenced. Lessons may be rescheduled in accordance with the cancellation and rescheduling policy, but they are not refundable once the service has started.

20. Technical Requirements

Because LearnWithNMT is an online service, learners are responsible for having the required technology to attend lessons and access learning resources: stable internet connection; suitable computer, tablet, or mobile device; working microphone and speakers/headset; camera where required or appropriate; access to Microsoft Teams or the required lesson platform; ability to open learning resources, worksheets, portal pages, and e-learning activities. LearnWithNMT is not responsible for lesson disruption caused by the learner's internet, device, software, audio, video, or local technical problems.

21. Student Conduct and Safeguarding Expectations

Learners must behave respectfully and appropriately during all lessons, group classes, portal interactions, emails, and communications with LearnWithNMT. Harassment, abuse, threats, discrimination, offensive language, or disruptive behaviour are not accepted. Learners must not share inappropriate content during lessons or through the portal. Learners must respect the trainer and other learners in group lessons. LearnWithNMT may suspend or terminate access without refund where serious or repeated misconduct occurs. For minors, parents/guardians are responsible for ensuring appropriate behaviour and a safe learning environment.

22. Recording Policy

Lessons may only be recorded with the mutual consent of both parties. Learners must not record, screenshot, publish, share, or distribute lesson content without written permission from LearnWithNMT. Unauthorised recording is prohibited. Unauthorised sharing of lesson recordings, screenshots, or materials is prohibited. Group lesson recordings, if any, must respect the privacy of all participants.

23. Intellectual Property

All LearnWithNMT materials remain the property of LearnWithNMT unless otherwise stated. Learners receive access for personal learning use only. This includes: lesson slides; worksheets; PDFs; PowerPoint files; videos and audio files; quizzes and H5P/e-learning activities; homework tasks; reports and templates; certificates; website and portal content; recorded or downloadable resources. Learners must not copy, reproduce, sell, publish, upload, distribute, modify, or share LearnWithNMT materials without prior written permission.

24. Privacy and Data Protection

LearnWithNMT may collect and process learner information for educational, administrative, communication, payment, safety, and legal purposes. This may include contact details, booking details, lesson records, progress information, homework submissions, payment confirmation, and parent/guardian information for minors. Personal information should be handled carefully and used only for legitimate LearnWithNMT purposes. Student records may be stored in the website, student portal, trainer portal, email systems, Microsoft services, or payment systems. Learners may contact LearnWithNMT about privacy questions using info@learnwithnmt.com. A separate Privacy Policy should be published on the website and should align with this handbook.

25. Limitation of Liability

LearnWithNMT provides professional English language training and learning support, but it does not guarantee specific outcomes, including: examination success; job offers or employment outcomes; promotions; visa approvals; immigration outcomes; university admission; specific language proficiency levels; business results or professional performance outcomes. Learner results depend on attendance, participation, effort, homework completion, independent study, starting level, goals, and learning consistency.

26. Force Majeure

LearnWithNMT shall not be liable for delays, interruptions, cancellations, or inability to provide services caused by events beyond reasonable control, including: internet outages; power failures; natural disasters; government actions; public emergencies; platform failures; payment provider issues; Microsoft/Teams/Bookings service interruptions; serious illness or emergencies. Where possible, LearnWithNMT will make reasonable efforts to reschedule affected lessons or provide a suitable solution.

27. Changes to Terms

LearnWithNMT may update this handbook and its Terms & Conditions when necessary. Updated versions may be published on the website, portal, or shared by email. The version date should be clearly shown. Continued use of LearnWithNMT services after publication of updated terms may be treated as acceptance of the updated terms.

28. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Republic of Mauritius. Any disputes arising from the use of LearnWithNMT services shall be subject to the jurisdiction of the courts of Mauritius, unless otherwise required by applicable law.

30. Communication Policy

LearnWithNMT may communicate with learners through email, Microsoft Teams, the student portal, website notifications, Microsoft Bookings, and WhatsApp where voluntarily provided. Learners are responsible for ensuring that their contact details remain accurate and up to date. LearnWithNMT is not responsible for missed communications caused by incorrect contact details, spam filters, full inboxes, unread messages, or failure to check notifications.

31. Technical Issues Policy

Learners are responsible for maintaining a stable internet connection, suitable device, microphone, speakers or headset, and access to Microsoft Teams or any other required lesson platform. If a lesson is disrupted due to technical issues on the learner's side, LearnWithNMT is not responsible for lost lesson time. If technical issues occur on the trainer's side, LearnWithNMT may, at its discretion, extend the lesson, reschedule the lesson, or return the lesson credit.

32. No-Show Policy

A no-show occurs when a learner fails to attend a scheduled lesson without prior notice. Lessons missed without sufficient notice may be marked as completed, and the lesson credit may be forfeited. Repeated no-shows may affect future booking access or learning progress.

33. Child Safeguarding Policy

LearnWithNMT is committed to providing a safe, respectful, and professional learning environment for children and young learners. Parents and guardians remain responsible for supervising minors where appropriate and ensuring a suitable learning environment. LearnWithNMT reserves the right to end or suspend a lesson where safeguarding concerns, inappropriate behaviour, or unsafe learning conditions arise.

34. Certificate Policy

Certificates may be issued for participation, attendance, achievement, or course completion. Certificates issued by LearnWithNMT do not constitute academic degrees, government qualifications, employment certification, immigration eligibility, or official language examination results. Certificate eligibility may depend on attendance, participation, completion of required activities, and programme requirements.

35. Website and Platform Availability

LearnWithNMT aims to maintain reliable access to its website, student portal, trainer portal, booking systems, and e-learning platforms. However, uninterrupted access cannot be guaranteed. Temporary interruptions may occur due to maintenance, updates, internet disruptions, third-party service issues, technical failures, or circumstances beyond LearnWithNMT's reasonable control.

36. Payment Disputes and Chargebacks

Learners agree to contact LearnWithNMT first to attempt to resolve any payment issue, billing concern, or service dispute before initiating a chargeback where reasonably possible. LearnWithNMT reserves the right to provide attendance records, booking history, payment confirmations, email records, portal activity records, lesson history, and other relevant information to payment providers where necessary. Where a chargeback is determined to be invalid, LearnWithNMT reserves the right to suspend or terminate access to services until the matter is resolved.

37. Website Checkout Acceptance Wording

The following checkbox must appear before payment, package purchase, or course enrolment:
